How Compliance Wihout Corruption Can Kill Democracy

Observing recent cases from a layman's perspective as they passed through the courts, I could not avoid the impression that some judges display real independence and audacity in their decisions, while others display a compliant lack of fortitude. Like dominated, dictated to spouses, it is "Yes Dear" all the way. No "Why Dear?" or a decisive "No Dear!" but just resignation to the path of least resistance or friction.

That kind of submissive compliance is all that is needed to turn any independent institution, be it police, judiciary or the office of the DPP, into a rubber stamp for government "bad-mind" or any political agenda that spits on the separation of powers.

Dishonesty or corruption does not enter the equation. Neither the police officer nor the judge has to be corrupt. I’m sure that every single police officer, from constable to commissioner, is honest, upright and righteous to a fault. So too, every single judicial official from Justice of the Peace to Clerk of the Peace, Magistrate, Court Master, and Judge, from Puisne to Appellate. They all have their seats divinely reserved for them at the right hand of whichever God they worship.

But spinelessness, paralysis, and compliance toward the people who can appoint you, disappoint you, pressure you, and ultimately dismiss you - is how Constitutions are undermined without ever breaking the letter of the law.

If we swallow the idea that law enforcement and the judiciary are above question just because one carries the power of the state and the other wears the symbols of justice, then we are rolling out the red carpet. We invite the compliant, the cowardly, and yes, the ill-intentioned, to dismantle our democracy from within - all while hiding behind the Constitution.

A title does not guarantee courage. Neither does legislation guarantee independence of mind.
